Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and BeyondGLP LLC, a Wyoming limited liability company ("BeyondGLP," "we," "us," or "our"), governing your access to and use of the website located at beyondglp.health, including all content, tools, assessments, guides, and any products or services made available through it (collectively, the "Site" or "Services"). BY ACCESSING OR USING THE SITE, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SITE.

1. Eligibility

You must be at least 18 years old and a resident of the United States to use the Site or purchase any product or service from us. The Site is not directed to, and we do not knowingly collect information from, anyone under 18. By using the Site, you represent and warrant that you meet these requirements and that you have the legal capacity to enter into these Terms. We currently offer the Services only to residents of the United States. If you access the Site from outside the United States, you do so on your own initiative and are responsible for compliance with local law.

2. Description of Services

BeyondGLP operates a physician-led metabolic health education platform. The Services currently include: Educational articles, guides, and research summaries relating to metabolism, appetite regulation, GLP-1 medications, and related topics ("Content"); A self-reported metabolic health questionnaire (the "Assessment") that generates an informational summary ("Metabolic Profile") based on your responses; and Email and SMS communications you opt into. We intend to introduce, in the future, one or more of the following, each of which will be governed by these Terms once live: (a) paid guidance programs or protocols ("Protocols"); and (b) physical consumer products, including dietary supplements ("Products"). Sections 6 through 9 apply specifically once Protocols and/or Products are offered for sale, and take effect automatically upon launch without a separate agreement, unless we notify you otherwise.

3. Not Medical Advice; No Doctor-Patient Relationship

This is the most important section of these Terms. Please read it carefully.

3.1 Educational purposes only. The Site, the Content, the Assessment, the Metabolic Profile, and any Protocols are provided for general educational and informational purposes only. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition, and they are not a substitute for professional medical advice, diagnosis, or treatment.

3.2 No doctor-patient relationship. Nothing on the Site, including any reference to Dr. Steven Gabriel, MD, or any other licensed professional, creates a physician-patient, therapist-client, or other clinical relationship between you and BeyondGLP, its founders, contributors, or affiliated professionals. Content authored or reviewed by a physician reflects general clinical knowledge and is not personalized medical guidance for your individual circumstances.

3.3 The Assessment is not a diagnostic tool. The Assessment is a self-reported questionnaire. The resulting Metabolic Profile, "Metabolic Score," and related outputs are informational estimates based solely on the information you provide. They are not laboratory results, biomarkers, or clinical assessments, have not been validated as a diagnostic or screening instrument, and should not be relied upon as a substitute for evaluation by a licensed healthcare provider.

3.4 Consult a healthcare provider. You should always consult a qualified physician or healthcare provider before making any changes to your diet, exercise, supplementation, or medication regimen, including any regimen involving GLP-1 receptor agonists or similar prescription drugs. Never stop, start, or change a prescription medication based on information from this Site without first speaking with your prescribing provider. If you are experiencing a medical emergency, call 911 or your local emergency number immediately.

3.5 No guarantees of results. Any outcomes, testimonials, or examples referenced on the Site are illustrative and not guarantees. Individual results vary based on numerous factors outside our control.

4. Assessment and Account Data

4.1 To use the Assessment, you provide self-reported information about your health, habits, and symptoms. Our collection, use, and protection of this information is governed by our Privacy Policy (beyondglp.health/legal/privacy), incorporated into these Terms by reference.

4.2 You agree to provide accurate information when using the Assessment. We are not responsible for the accuracy of a Metabolic Profile generated from inaccurate or incomplete input.

4.3 If we introduce user accounts, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at support@beyondnow.health of any unauthorized use.

5. Email and SMS Communications

By submitting your email address or phone number through the Site, you consent to receive marketing and transactional communications from us via email and, where applicable, SMS text message, delivered through our messaging platform provider. Message and data rates may apply for SMS. You may opt out of marketing emails at any time via the unsubscribe link in any email, and opt out of SMS by replying STOP. Opting out of marketing communications does not opt you out of transactional messages related to a Protocol or Product purchase (e.g., order confirmations, shipping notices).

6. Products and Protocols (Future Offerings)

This Section 6 applies once BeyondGLP begins offering Protocols and/or Products for purchase.

6.1 Dietary supplement disclosures. Any Products we sell that constitute dietary supplements are not intended to diagnose, treat, cure, or prevent any disease. These statements have not been evaluated by the Food and Drug Administration. Products are not a replacement for prescription medication, including GLP-1 receptor agonist medications, and are not represented as producing GLP-1-equivalent effects. Always read product labeling and consult your healthcare provider, particularly if you are pregnant, nursing, have a medical condition, or are taking prescription medication, before using any Product.

6.2 Product descriptions. We attempt to describe Products and their ingredients accurately. We do not warrant that Product descriptions, images, or other content are complete, reliable, current, or error-free. If a Product is not as described, your sole remedy is to return it under Section 8.

6.3 Orders and acceptance. Your order is an offer to purchase. We may accept or decline any order, in whole or in part, for any reason, including product availability, pricing errors, or suspected fraud. A charge to your payment method does not, by itself, constitute acceptance; acceptance occurs when we ship the Product or confirm the start of a Protocol.

6.4 Pricing. Prices are stated in U.S. dollars and are subject to change without notice. We are not responsible for pricing or typographical errors and reserve the right to cancel orders arising from such errors, with a full refund.

6.5 Subscriptions (if applicable). If a Product or Protocol is offered on a recurring basis, the specific billing, cancellation, and renewal terms will be disclosed at checkout and incorporated into these Terms. You may cancel at any time before the next billing date via your account or by contacting support@beyondnow.health; cancellation takes effect for the next billing cycle and does not entitle you to a refund of amounts already charged, except as provided in Section 8.

6.6 Payment processing. Payments are processed through our third-party payment processor. We do not store your full payment card information.

6.7 Shipping. We currently ship only within the United States. Delivery estimates are provided in good faith and are not guaranteed. Risk of loss and title pass to you upon our delivery to the shipping carrier.

7. Third-Party Providers

We rely on third-party service providers to operate the Site, including email/SMS marketing infrastructure (Klaviyo), advertising and analytics platforms (Meta, TikTok, Google), and payment processing services. We are not responsible for the acts, omissions, downtime, or errors of third-party providers, though we select and monitor them with reasonable care.

8. Returns and Refunds

8.1 Standard return window. You may return an unopened, unused Product within 30 days of the delivery date for a refund of the purchase price, excluding original shipping charges. Contact support@beyondnow.health with your order number to initiate a return.

8.2 Condition of returns. Products must be returned in original, unopened packaging. Opened or used Products are ineligible unless defective or materially not as described, evaluated case-by-case.

8.3 Return shipping. Unless the return is due to our error or a defective Product, you bear return shipping costs.

8.4 Refund processing. Approved refunds are issued to your original payment method within 10 business days of our receipt and inspection of the returned Product.

8.5 All Sales Final. Due to the personalized and digital nature of the BeyondGLP Protocol, all purchases are final. We do not offer refunds after access to the Protocol is granted. If you believe you have been charged in error, please contact us at support@beyondnow.health within seven (7) calendar days of the transaction date and we will review your request on a case-by-case basis. Nothing in this section limits any rights you may have under applicable consumer protection law.

8.6 Final sale items. Any Product or Protocol expressly marked "final sale" at checkout is not eligible for return or refund.

9. Intellectual Property

All Content, trademarks, logos, the BeyondGLP name and brand, the Assessment methodology, and all other Site materials are owned by BeyondGLP or its licensors and protected by U.S. and international IP law. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial use. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or exploit any Content without our prior written consent.

10. User Submissions

If the Site permits reviews, comments, or testimonials ("User Content"), you grant BeyondGLP a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to use, reproduce, modify, publish, and display such User Content in any media for any purpose, including marketing. You represent you own or have rights to the User Content and it violates no third-party right. We may remove User Content at our discretion.

11. Prohibited Conduct

You agree not to: (a) use the Site unlawfully; (b) attempt unauthorized access to the Site, other accounts, or our systems; (c) scrape or data-mine the Site without written permission; (d) reverse engineer or attempt to derive the Assessment's underlying methodology; (e) impersonate any person or misrepresent affiliation; (f) interfere with the Site's proper functioning; or (g) resell or commercially exploit any Product, Protocol, or Content without our written authorization.

12. Third-Party Links

The Site may link to third-party websites not owned or controlled by BeyondGLP. We are not responsible for the content, privacy practices, or terms of any third-party site.

13. Disclaimer of Warranties

THE SITE, CONTENT, ASSESSMENT, PROTOCOLS, AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY PRODUCT, PROTOCOL, OR ASSESSMENT RESULT WILL PRODUCE ANY PARTICULAR HEALTH OUTCOME. Some jurisdictions do not allow exclusion of certain warranties, so some exclusions may not apply to you.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEYONDGLP, ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AFFILIATED PHYSICIANS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR HEALTH OUTCOMES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL BEYONDGLP'S AGGREGATE LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO BEYONDGLP IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100.

15. Indemnification

You agree to indemnify, defend, and hold harmless BeyondGLP and its members, officers, employees, contractors, and affiliated physicians from claims, liabilities, damages, and expenses, including reasonable attorneys' fees, arising from: (a) your violation of these Terms; (b) your use of the Site, Assessment, Protocols, or Products; (c) your violation of law; or (d) your violation of any third-party right.

16. Dispute Resolution: Binding Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHT TO SUE IN COURT AND TO A JURY TRIAL.

16.1 Agreement to arbitrate. Except as set forth in 16.5, you and BeyondGLP agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, the Assessment, any Protocol, or any Product ("Disputes") will be resolved exclusively through final, binding arbitration rather than in court, except that you may bring qualifying claims in small claims court.

16.2 Arbitration procedure. Arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect, before a single arbitrator, conducted by phone, video, written submissions, or in person in the county of your residence, at your election. The arbitrator's decision is final, binding, and enforceable in any court of competent jurisdiction. Each party bears its own attorneys' fees and costs except as AAA rules or law require or permit otherwise.

16.3 Class action waiver. YOU AND BEYONDGLP EACH AGREE THAT ANY PROCEEDING WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION, AND EACH WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION OR CLASS-WIDE ARBITRATION. If this waiver is found unenforceable as to a particular claim, that claim must be severed and litigated in court, with all other claims remaining subject to arbitration.

16.4 Right to opt out. You may opt out of this arbitration agreement by sending written notice to BeyondGLP LLC, 30 N Gould St STE R, Sheridan, WY 82801, or to support@beyondnow.health, within 30 days of first accepting these Terms, stating your name and clear intent to opt out. If you opt out, all other provisions of these Terms remain in effect.

16.5 Exceptions. Either party may bring an individual action in small claims court, or seek injunctive/equitable relief in court to prevent IP infringement or misuse.

16.6 Severability of arbitration terms. If any part of Section 16, other than the class action waiver in 16.3, is found unenforceable, the remainder of Section 16 remains in effect.

17. Governing Law and Venue

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-laws principles, except where preempted by federal law. For any Dispute not subject to arbitration (small claims actions or claims excluded under 16.5), you agree to the exclusive jurisdiction and venue of state and federal courts located in Wyoming.

18. Modifications to the Site and Terms

We may modify, suspend, or discontinue the Site or any Content, Assessment feature, Protocol, or Product at any time without liability. We may revise these Terms; the "Last Updated" date reflects the most recent revision. Continued use after changes take effect constitutes acceptance.

19. Termination

We may suspend or terminate your access at any time, with or without cause or notice, including for violation of these Terms. Sections 3, 9–17, and 20 survive termination.

20. General Provisions

20.1 Entire agreement. These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement, superseding prior agreements.

20.2 Severability. Invalid provisions are limited or eliminated to the minimum extent necessary; remaining provisions stay in force.

20.3 No waiver. Failure to enforce any provision is not a waiver of the right to enforce it later.

20.4 Assignment. You may not assign these Terms without our written consent. We may assign without restriction, including in a merger or asset sale.

20.5 Force majeure. We are not liable for delay or failure caused by events beyond our reasonable control.
