BeyondGLP LLC, a Wyoming limited liability company ("BeyondGLP," "we," "us," or "our"), operates beyondglp.health (the "Site"). This Privacy Policy explains what information we collect, how we use and share it, and the choices available to you. By using the Site, you agree to the practices described here. If you do not agree, do not use the Site. This Policy should be read together with our Terms of Service and Cookie Policy.

1. Important Note on Health Information and HIPAA

BeyondGLP is not a covered entity or business associate under the Health Insurance Portability and Accountability Act ("HIPAA"), and the information you provide through our Metabolic Health Assessment (the "Assessment") is not protected health information ("PHI") under HIPAA. We are not a healthcare provider, health plan, or clearinghouse, and using the Site does not create a doctor-patient relationship. That said, we treat the self-reported health information you share through the Assessment as sensitive, and we describe below the safeguards, uses, and limits that apply to it.

2. Information We Collect

2.1 Information you provide directly: Assessment responses: self-reported answers about hunger, cravings, energy, sleep, digestion, weight history, medication use (including GLP-1 medications), and related lifestyle and health information. Contact information: name, email address, phone number, and, once purchases are available, billing and shipping address. Communications: messages you send us via email, contact forms, or customer support. Order information (future): purchase history, products purchased, and payment-related information (processed by our third-party payment processor; we do not store full card numbers). Marketing preferences: your email/SMS opt-in status and communication preferences.

2.2 Information collected automatically: Device and usage data: IP address, browser type, device identifiers, pages viewed, referring URLs, and time spent on pages. Cookies and tracking technologies: collected via cookies, pixels, and similar technologies, including Meta Pixel, TikTok Pixel, and Google Analytics/Google Ads. 2.3 Information from third parties: Data from our advertising and analytics partners (Meta, TikTok, Google) related to ad performance and audience matching, such as hashed identifiers used for ad targeting and measurement. Delivery and engagement data from our email/SMS platform, Klaviyo.

3. How We Use Your Information

We use the information we collect to: Generate your Metabolic Profile and Assessment results; Provide, maintain, and improve the Site and Content; Send you the emails and/or SMS messages you've opted into, including educational content, offers, and (once available) order and shipping updates, via Klaviyo; Personalize marketing and measure the performance of our advertising, including through Meta, TikTok, and Google; Process orders and payments, once purchasing is live; Detect, investigate, and prevent fraud, abuse, and security incidents; Comply with legal obligations and enforce our Terms of Service; and Conduct internal analytics and research to improve the Assessment and our Content, generally using aggregated or de-identified data where feasible. We do not use your individual Assessment responses to make automated decisions that produce legal or similarly significant effects concerning you.

4. How We Share Your Information

We do not sell your health information, and we do not share your individual Assessment responses with advertising platforms for ad targeting. We may share information as follows: Service providers: with vendors who perform services on our behalf, including Klaviyo (email/SMS delivery), our hosting and infrastructure provider, our future payment processor, and analytics/advertising platforms (Meta, TikTok, Google) — limited to the categories of information described in Section 2, and, for the ad platforms, generally limited to contact and device/usage data rather than Assessment health responses. Legal and safety reasons: to comply with law, respond to legal process, or protect the rights, property, or safety of BeyondGLP, our users, or the public. Business transfers: in connection with a merger, acquisition, financing, or sale of assets, subject to standard confidentiality protections. With your consent: for any other purpose we disclose to you at the time of collection, with your consent. "Sale" and "sharing" under state privacy laws: Some U.S. state privacy laws define "sale" or "sharing" broadly enough to include disclosures to advertising platforms for cross-context behavioral advertising, even without an exchange of money. To the extent our use of advertising pixels (Meta, TikTok, Google) constitutes a "sale" or "sharing" of personal information under applicable state law, you can opt out as described in Section 8.

5. Data Retention

We retain your information for as long as reasonably necessary to provide the Services, comply with legal obligations, resolve disputes, and enforce our agreements. We retain your personal information for as long as your account remains active and for a period of five (5) years following your last interaction with our Services, unless a longer retention period is required or permitted by applicable law. Health and wellness information you provide may be retained for up to seven (7) years in accordance with applicable health record-keeping standards. You may request deletion of your personal information at any time by contacting support@beyondnow.health; such requests are subject to our legal obligations and legitimate business interests.

6. Data Security

We use commercially reasonable administrative, technical, and physical safeguards designed to protect your information, including encryption in transit, access controls, and vendor vetting. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security. If we experience a data security incident affecting your personal information, we will notify you as required by applicable law.

7. Children's Privacy

The Site is intended for users 18 and older and is not directed to children under 13 (or under 16, where applicable state law sets that threshold). We do not knowingly collect personal information from children. If we learn we have collected information from a child in violation of this Policy, we will delete it promptly. 8. Your Privacy Rights and Choices

8.1 Marketing opt-out. Unsubscribe from marketing emails via the link in any email, or reply STOP to opt out of SMS. You may still receive transactional messages related to an order.

8.2 Cookie and ad choices. See our Cookie Policy to manage cookies and opt out of Meta, TikTok, and Google advertising and analytics tracking.

8.3 State privacy law rights. Depending on your state of residence (including California, under the CCPA/CPRA, and other states with comprehensive privacy laws), you may have the right to: Know/access the categories and specific pieces of personal information we hold about you; Delete personal information we hold about you, subject to certain exceptions; Correct inaccurate personal information; Opt out of the "sale" or "sharing" of personal information, or of targeted/cross-context behavioral advertising; Opt out of certain profiling in furtherance of automated decisions with legal or similarly significant effects; and Not be discriminated against for exercising these rights. To exercise any of these rights, contact us at support@beyondnow.health. We will verify your identity before responding and will respond within the time required by applicable law. You may designate an authorized agent to submit a request on your behalf, subject to verification.

8.4 Do Not Track. Our Site does not currently respond to browser "Do Not Track" signals, but where required by law (e.g., California's Global Privacy Control recognition requirements), we honor recognized universal opt-out signals for sale/sharing and targeted advertising opt-outs.

9. Geographic Scope

We currently offer the Site and Services only to individuals located in the United States, and this Policy is written with U.S. privacy law in mind. If we begin offering Services outside the United States, we will update this Policy to address applicable requirements (such as GDPR) before doing so.

10. Third-Party Links

The Site may link to third-party websites. This Policy does not apply to those sites, and we encourage you to review their privacy policies independently.

11. Changes to This Policy

We may update this Policy from time to time. The "Last Updated" date above reflects the most recent revision. Material changes will be posted on the Site, and, where required by law, we will provide additional notice or obtain renewed consent.
